FERPA...Family Education Rights and Privacy Act
The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99) is a Federal law that protects the privacy of Student ed-ucation records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education, which includes Mayland Community College.
FERPA... gives students and parents certain rights with respect to the educational records. The high school is responsive and reactive to the student with the respect to this information.
For Students in Regard to High School Information:
Q. Student Records
A. Parents and students have the right to inspect
Q. Correction of records
A. Parents and students have the right to request that school correct records.
Q. Release information from a student's education record.*
A. Can only be released if a parent or student pro-vides written permission
Q. Access to schedules and grades
A. Parents have the right to see students' schedules and grades.
For Students in Regard to College Information:
Q. Student Records
A. Only students have the right to inspect, unless they sign a waiver for the college to share with an-other party.
Q. Correction of records
A. Only student have the right to make the request, unless they sign a waiver.
Q. Release information from a student's education record.*
A. Can only be released if a student provides writ-ten permission. If the student signs a waiver, then the parent may sign to release the information.
Q. Access to schedules and grades
A. Parents can only gain access to class schedules and grades with students' written consent.
* However, FERPA allows schools to disclose those records, without consent, to the following parties or under the following conditions (34 CFR § 99.31):
School officials with legitimate ed-ucational interest;
Other schools to which a student is transferring;
Specified officials for audit or evaluation purposes;
Appropriate parties in connection with financial aid to a student;
Organizations conducting certain studies for or on behalf of the school;
Accrediting organizations;
To comply with a judicial order or lawfully issued subpoena;
Appropriate officials in cases of health and safety emergencies; and
State and local authorities, within a juvenile justice system, pursuant to specific State law.
Directory Information
Schools may disclose, without consent, "directory" information such as a student's name, address, telephone number, date and place of birth, honors and awards, and dates of attendance. However, schools must publish information pertaining to directory information and allow reasonable time to request that the school not disclose directory information.
